BUSINESS LITIGATION
The firm handles a wide variety of business disputes for clients ranging from Fortune 500 corporations to small, closely-held businesses and individuals. In addition to cases before judicial tribunals, Mr. Scriven also handles administrative matters before state and local agencies, including county commissions, city councils, and executive agencies. He understands that the value of the firm's representation is measured both by the results obtained and the satisfaction of the firm's clients. Thus, he approaches each case committed not only to vigorous advocacy but with a sensitivity to handling matters in the most cost-effective manner possible.
In today's litigious environment, it is unusual for a case to proceed to trial without proceeding through some type of Alternative Dispute Resolution ("ADR"), such as arbitration or mediation. ADR is a growing practice area that provides a means of settling disputes in a manner that reduces the cost, uncertainty, and injury to business and personal relationships that are attendant to traditional litigation. Mr. Scriven has substantial experience in mediation, having participated in mediation as both a lawyer and a mediator. He also serves on the commercial panel of the American Arbitration Association.
APPELLATE PRACTICE
Effective representation of clients in appellate matters requires an attorney with demonstrated experience. Mr. Scriven handles appeals in a wide array of contexts, including appeals of final orders and judgments of trial courts; appeals of non-final orders, extraordinary writs, and appeals of decisions of local governments and administrative boards. He formerly clerked for the United States Court of Appeals for the Eleventh Circuit.
Mr. Scriven frequently handles appeals originating within the firm as well as appeals and post-trial matters referred by other attorneys in cases in which the firm was not trial counsel. Mr. Scriven has also served as counsel of record for organizations wishing to participate in appellate proceedings as "amicus curiae" or friends of the court, including before the Florida Supreme Court.
